Booking Contract:
Any contract between you and Spanish Footsteps SL is subject to these Booking Conditions.

Deposit & Final Payment:
To reserve your place on a journey, a deposit of €200 per person is required. Upon receipt of the deposit Spanish Footsteps will provide you with a confirmation invoice.  The balance is required to be paid no less than 56 days prior to the journey start date.  If the journey start date is less than 56 days from the date of reservation, payment in full is required.  If payment of the balance is not received by the due date, Spanish Footsteps reserves the right to treat your booking as cancelled by you and to apply our cancellation conditions accordingly.

Minimum passenger requirements:
Our guided journeys are based on an achieving a minimum number of 6 passengers.  Should the minimum number not be reached, we reserve the right to cancel a guided journey.  If the guided journey is cancelled and we notify you either via email or in writing more than 58 days prior to journey start date we will not be liable to pay you any compensation.

In the event of the cancellation of a guided journey by us due to minimum numbers not being reached we will offer you the choice of an alternative journey of equal value, if available, or a journey of lesser value if you request it, again if available.  If a journey of lesser value is chosen we will provide a refund of the difference in price between the original booking and the journey of lesser value;  if a journey of high value is chosen we will require you to pay the difference between the original booking and the journey of higher value; or if no new journey is chosen we will provide you with a timely refund of all monies paid by you to Spanish Footsteps under the original booking. In the unlikely event that we need to cancel a guided journey less than 58 days prior to the start date, we will offer compensation to you as detailed below.

Spanish Footsteps is not liable to pay compensation to you where:
The guided journey is cancelled because the minimum number of passengers has not been reached as described above and you are advised of the cancellation via email or in writing more than 58 days prior to the start date of your journey or the journey (self guided, guided or custom made) is cancelled due to unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised.

If you choose not to accept Spanish Footsteps offer of compensation as detailed above you may refer your claim for compensation to arbitration as detailed below.

Change or addition to your booking:
If you want to change any part of your journey or additional services after the confirmation invoice has been issued, we will do our best to make the change, but you need to be aware it may not be possible. All requests for changes must be made in writing by the person who made the original booking. If it is possible to make the change, it will be subject to an administration charge of €15 per person, plus payment of any additional costs incurred as a result of the change, ie amendment costs charged by our service providers or costs incurred due to changes in group size. If the changes cannot be made you have the choice of proceeding with your journey as originally booked, or of canceling your journey and paying cancellation charges in accordance with the table below. Please note that it will not be possible to make changes within 28 days of your scheduled journey start date.

Should you wish to transfer the journey booked to another person you may do so as long as the person who you are transferring the journey to satisfies all the conditions applicable to the package.  We would request you give reasonable notice of your intention to transfer before the date of departure. All transfers will be subject to an administration charge of €15 per person.  We will also advise you of any additional charges that may be resulting from such a transfer prior to effecting said transfer.

Changes to Journey descriptions:
You need to be aware that the nature of this type of holiday requires flexibility and you need to allow for alternatives. The outline itinerary provided for each guided journey is an indication of what walks may be undertaken and does not form a contractual obligation on the part of Spanish Footsteps SL. The routes and schedules may be subject to alteration without prior notice due to unpredictable or unforeseeable circumstances.  Therefore we reserve the right to change the itinerary depending on availability of suppliers, disruptive weather conditions, emergency repairs, government closure of sites etc.  In the event of a change, a supplier of equal or greater value and quality will be chosen where possible.

In the case of minor changes, we will, if able to, advise you of such changes but we are not obliged to do so nor are we liable to pay any compensation. In the event of a sizeable change (defined as a change of more than 30% of the duration of your holiday) Spanish Footsteps will make every effort to provide you with as much advance notice as possible.

If time allows before departure, you may choose from the following options:
- accept the altered arrangements.
- book an alternative holiday if we have one available
- cancel your holiday and accepting a full refund of all monies paid, excluding any amendment charges.

In addition, in appropriate cases, and where the change is not made as a result of force majeure as defined below, you maybe entitled to compensation as set out above. (see Spanish Footsteps journey cancellation table)

If after departure, a sizeable proportion of the services contracted cannot be provided, you will have the choice of:
-accepting the alternative arrangements,
-returning to your point of departure,

In addition, if appropriate, we may pay you compensation of an amount which is reasonable taking into account the proportion services not provided or significantly altered.

Spanish Footsteps will not be liable to pay compensation if changes occurred due to unusual and unforeseeable circumstances beyond our control, the consequences of which neither we nor our suppliers could avoid.

Spanish Footsteps regrets that we cannot pay for any expenses, costs or losses incurred by you as a result of any changes, including but not limited to flight, bus, ferry or train tickets, additional accommodation and car hire you may have purchased independently in the event of cancellation of a journey or a sizeable change to the journey.  Spanish Footsteps is not liable to pay compensation for any additional costs incurred as a result of changes in published flight, bus, train or ferry routes featured on this website.

To Cancel Your Booking:
Should you wish to cancel your journey you are required to notify us directly in writing as soon as possible, this must be done by the person who originally booked the journey. The scale of cancellation charges detailed is calculated according to the number of days prior to departure that written notice of cancellation is received by Spanish Footsteps:

We regret that Spanish Footsteps  cannot accept liability or pay you any compensation where our contractual obligations are prevented by, or you suffer any damage or loss as a result of 'force majeure'.
Force Majeure means any unusual and unforeseeable circumstances beyond our control, the consequences of which neither we nor our suppliers could avoid. Such events may include war or threat of war, riots, civil strife, terrorist activity, industrial disputes, natural or nuclear disaster, fire, adverse weather conditions, level of water in rivers, streams or canons  or other similar events beyond our control.

Arbitration:
Should you experience a problem, you must notify your Spanish Footsteps representative immediately, who will endeavour to resolve the problem at this time. In the unlikely event that you are not satisfied with the measures undertaken to deal with your grievance and you would like to pursue the matter further, you are required to put your complaint in writing to Spanish Footsteps within 2 weeks of your journey end date providing all the relevant details. We undertake to deal with any dispute in a timely manner, taking into consideration the terms and conditions set out here.  Should the results of this not be to your satisfaction we would refer you to the nearest branch of the European Consumer Centre who will be able to provide you with more information and or assistance in connection with arbitration relating to services acquired in a country other than your own.  This service is specifically for those consumers who are from an EU member state.

Health and Safety:
Spanish Footsteps will take all reasonable measures expected of a tour operator in relation to your safety and well being.  Your booking contract is established on understanding that the persons traveling are usually in good health and are able to meet the physical demands of the journey booked. All journeys are undertaken at your own risk and we reserve the right to refuse a passengers participation in a particular activity or a complete journey if we believe it is for their own safety and the safety of other passengers.

You are required to inform Spanish Footsteps of any dietary needs, medical conditions or allergies that we may need to know about to enable us to make the necessary arrangements.  You will be provided with a form to complete at the time a confirmation invoice is issued.  This form must be completed & return to us within 10 days of us sending it. If this form is not returned within the time period specified we will assume you have no dietary needs, medical conditions or allergies to advise. Should Spanish Footsteps be unable to secure the necessary dietary or medical arrangements you require you will be notified in writing or via email within 7 days of us receiving your information. If subject to this notification you wish to cancel your journey we will provide you with a timely refund of all monies paid by you to Spanish Footsteps under the original booking, not subject to either compensation or cancellation charges.  We would encourage all passengers with specific dietary, allergy or medical needs to contact us to discuss prior to making any bookings.

If dietary, allergy or medical information is provided to Spanish Footsteps after the time specified we will endeavour to make the necessary arrangements but cannot guarantee your needs can be met, therefore we will notify you accordingly.  At this time you will have the choice of proceeding with your journey as originally booked, or of canceling your journey and paying cancellation charges in accordance with the passenger cancellation table shown above.

You must follow the advice and direction provided by Spanish Footsteps and our suppliers, comply with the local codes of conduct and act in a prudent and sensible manner at all times. Some activities, meals and meal times in our guided journeys may not be suitable for children. With self guided and custom made journeys activities and meals are determined by you, therefore participation of children is at your discretion.  All children booked on any journey are the full responsibility of  the accompanying adult and therefore we will not accept a booking for a child without one for an accompanying adult.

We will not accept responsibility for loss or injury suffered by you where, you have not followed the direction of us or our suppliers, the loss or injured can be attributed to your actions or the actions of someone not connected with Spanish Footsteps.

Insurance:
We strongly recommend you purchase cancellation insurance to prevent any financial loss in case of illness, accident, or other situations causing you to cancel your journey with us. We also require that you have taken out comprehensive travel and medical insurance before commencing a journey. Should a journey be cancelled by you for any reason we regret to inform you we must adhere strictly to our cancellation policy.

UK Customers -

Inclusions/Exclusions:
What is or is not included in the price of your journey is advised on the itinerary for each specific journey.  Therefore please refer to the itinerary for details.

Spanish Footsteps Insurance Coverage:
In line with the "UK Package Travel, Package Holidays and Package Tours Regulations 1992" and the EU Tour Regulations all guests booked with Spanish Footsteps SL are fully protected for the initial deposit and subsequent balance of all payments made to us. This protection is in the form of an insurance policy against insolvency (Caucin ante la Administraci n). Should cancellation or curtailment of your tour occur in the unlikely event of the insolvency of Spanish Footsteps SL your payment is protected and you will receive a refund of monies paid as well as compensation for repatriation expenses if appropriate.

Whilst Spanish Footsteps SL has public liability insurance coverage we cannot be held responsible for accidents, injury, loss, damage or additional costs resulting from circumstances beyond our control or the actions of someone not connected with Spanish Footsteps SL. We strongly recommend all guests ensure their travel insurance provides sufficient cover in the event of cancellation, personal accident, illness, lost or damaged personal possessions.

Please note this booking contract with Spanish Footsteps SL is subject exclusively to Spanish Law.
